2. The petitioner seeks bail in connection with Barachatti P.S. Case No. 597 of 2019 registered for the offences under Sections 8, 20 and 22 of the N.D.P.S. Act.

3. The prosecution story in short is that the police personnel reached Piprahi village and found that some land was being cultivated with contraband namely Ganja. The police was informed by the local persons that the land belongs to Mahadev and Sahdev Yadav (petitioner) and they have been cultivating Ganja for long.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case merely because he carries a long list of criminal antecedent of similar

The learned counsel has stated that the land does not belong to the petitioner and nothing has come during the course of investigation to suggest that the petitioner was cultivating the said land. The learned counsel has next submitted that during investigation nothing has come to suggest that the said plants were actually Ganja nor the assessment has been done with regard to the total contraband which was being cultivated allegedly by the petitioner. Lastly it has been submitted that the petitioner is in custody since 24.11.2024.

5. The learned Additional Public Prosecutor for the State has opposed the prayer for bail and has stated that the witnesses from the said village have named that the petitioner along with Mahadev Yadav have been cultivating the said land for long and using it for production of Ganja.

Considering the aforesaid submissions and taking into account that there is nothing to connect the petitioner with the said land where the said contraband was being cultivated, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cum-Special Judge, NDPS Act, Gaya in connection Barachatti P.S. Case No. 597 of 2019 subject to the

Patna High Court CR. MISC. No.1906 of 2025(6) dt.09-05-2025 3/3 conditions that a. One of the bailors of the petitioner shall be her close relative.

b. The petitioner shall remain physically present in Court on each date of the trial.

c. In case of absence on two consecutive dates, or in violation of the terms of the bail and if the prosecution is found involvement of the petitioner in similar nature of offence, the bail bond of the petitioner will be liable to be canceled by the Court concerned.
