Mr.Akhileshwar Dayal ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 24-01-2019 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in Ara Nagar P.S. Case No. 383/2018, instituted for offences under Section(s) 406, 420, 120(B)/34 of the Indian Penal Code.

It is alleged in the written report that this petitioner along with other named accused persons opened a branch in Ahmad Complex, Ara under D.J.N. Group of Company and made publicity. The accused persons convinced the local people stating therein that the person who deposits money in their company will get interest at the rate of 4% on the deposited amount and the interest amount will be paid in the account. It is alleged that informant deposited an amount of Rs. 7,000/- through

Patna High Court Cr.Misc. No.2921 of 2019(2) dt.24-01-2019 2/2 cheque. Later on informant learnt that petitioner along with other accused persons have fled away after closing the company. Learned counsel for the petitioner has submitted that it is purely civil dispute.

It appears from the complaint that informant had voluntarily deposited the amount in the aforesaid company. There was no any force applied by petitioner to deposit the amount.

Petitioner is in custody since 22.10.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Ara in connection with Ara Nagar P.S. Case No. 383/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
