JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Six kg. charas kept in packets are said to have been recovered from the jacket of the petitioner.

The contention on behalf of the petitioner is that petitioner has been implicated in this case at the instance of his enemies and as a matter of fact, petitioner gave a petition to Janta Darbar and after that enquiry was conducted by the Inspector General of Police, Muzaffarpur who suspected the prosecution story in his report dated 29.12.2014 which has been annexed as Annexure-2 to this petition.

Admittedly, after investigation, police submitted charge sheet against the petitioner and, therefore, considering the

No.7273 of 2015 (2) dt.02-03-2015 allegation levelled against the petitioner as well as facts and circumstances of the case, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Trial No. 50 of 2013 arising out of Shikarpur P.S. Case No. 40 of 2013 pending in the court of 2nd Additional Sessions Judge, Bettiah, West Champaran stands rejected.
