ANJANA PRAKASH ORAL JUDGMENT Date: 02-07-2015 The Petitioner seeks revision of the judgment of conviction dated 5.12.2014 passed by the Sessions Judge, Kaimur at Bhabua in Criminal Appeal No.4 of 2014/351 of 2014, by which he has upheld the conviction of the Petitioner passed on 29.1.2014 by the Judicial Magistrate, 1st class, Kaimur at Bhabua in Kuchhila P.S. case No.8 of 2009 (G.R. No.472 of 2009 Trial No.323 of 2014) under the provisions of arms Act and maintained the sentence of 2 years R.I. and fine of Rs.5000/-, in default of which simple imprisonment for another one month.

Having considered the period of custody of the Petitioner as also the date of occurrence, the sentence is modified to the period already undergone by him. However, he is required to deposit the fine

Patna High Court CR. REV. No.216 of 2015 dt.02-07-2015 2/2 as directed by the Court below within a period of eight weeks from the date of receipt of this order, failing which he shall be sentenced to imprisonment as directed by the court below.

With the aforesaid modification in sentence, the revision application stands dismissed.
