JUSTICE AMARESH KUMAR LAL ORAL ORDER 23-06-2015 Heard the learned counsel for the petitioner and the learned counsel for the State.

The petitioner seeks bail in Bihta P.S. Case No.244/2014 registered for the offence punishable under Sections 498A, 304B/34 of the Indian Penal Code.

The allegation against the petitioner and others is to have strangulated the deceased Lila Devi, daughter of the informant due to non-fulfillment of demand of dowry.

It is submitted that the petitioner is the husband of the deceased. The deceased had committed suicide. There is no specific allegation of overt act against the petitioner. At the time of occurrence, the petitioner was outside the house. The learned counsel for the State submits that the petitioner is the husband of the deceased. During investigation, it has

As per post mortem examination report, the cause of death of the deceased is strangulation. After investigation, case has been found true. Considering the facts and circumstances of the case, in my opinion, the petitioner does not deserve bail at this stage. His prayer is rejected.
