While granting bail to the petitioner vide order dated 26.03.2015 under Criminal Miscellaneous No. 48587 of 2014, the bail bond was to be executed and accepted to the satisfaction of 2nd Additional Sessions Judge, Darbhanga in connection with Sessions Trial No333 of 2014 arising out of Sadar P.S. Case No. 132 of 2014 on account of averments so made under the pleading of the aforesaid criminal miscellaneous. Now it has been submitted that Sadar P.S. Case No. 132 of 2014 is still pending before the learned Chief Judicial Magistrate, Darbhanga and on account thereof, the learned counsel for the petitioner submitted instant petition for modification in the order dated 26.03.2015.
Patna High Court Cr.Misc. No.22174 of 2015 (3) dt.29-07-2015 2/2 Learned counsel for the petitioner has filed certified copy of order sheet of Sadar P.S. Case No. 132 of 2014 wherefrom it is apparent that same is pending before the learned Chief Judicial Magistrate, Darbhanga. That being so, the last operative portion of the order dated 26.03.2015 passed in Cri. Misc. No. 48587 of 2014 is modified to the extent ' to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Sadar P.S. Case No. 132 of 2014' and the order dated 26.03.2015 passed in Cri. Misc. No. 48587 of 2014 accordingly be read. Consequent thereupon Cri. Misc. No. 22174 of 2015 is allowed.
