The petitioner apprehends his arrest in Balia P.S. Case No.188/18 registered for the offence under Section 30(a), 32, 41(1) of Bihar Prohibition and Excise Act.

Learned Counsel for the petitioner submits that it is a case of recovery of total 1650 litres of Indian made foreign liquor from a maize field, whereas petitioner is not named in the F.I.R. and his name has surfaced during course of investigation. It is further submitted that the petitioner is having clean antecedent. He further submits that other co-accused has granted anticipatory bail by Cr. Misc. No. 74865 of 2019 Considering the aforesaid facts and circumstances as well as nature of accusation, in the event his arrest/surrender within a period of six weeks from today, let the above named

Patna High Court CR. MISC. No.3147 of 2020(2) dt.28-02-2020 2/2 petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Session Judge 2nd cum special Judge Excise, Begusarai in connection with Balia P.S. Case No.188/18 on the following conditions: "(1) Petitioner shall cooperate in the tiral and shall be properly represented on each and every date fixed by the Court and shall remain physically present, as directed by the Court and on his absence on two consecutive dates without sufficient reason, his bail-bond shall be cancelled by the Court below.

(2) If the petitioner tamper with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail."
