SONI SHRIVASTAVA ORAL ORDER 30-04-2025 As both these bail applications have cropped up from the same police station case number, hence, with consent of parties, they are being heard together and disposed of by this common order.

2. Heard learned counsel for the petitioners and learned APP for the State.

3. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 30(a)/47 of the Bihar Prohibition and Excise Act.

4. A perusal of the First Information Report and the seizure list would go to show that 2000 liters of cough syrup has been recovered from a truck bearing Registration No. WB19J9364 and the codein content in the said syrup is said to be around 400 grams.

5. Learned counsel for the petitioners submits that the allegation is that the said consignment was going to be delivered to the shop of the petitioner Sonu Anand who has a firm namely Anand Drug Agency holding a valid drug license. The petitioners have annexed in his petition the relevant documents with regard to the consignment which is Annexures 3 and 4 to this petition. It has been submitted by the learned counsel for the petitioners that the petitioner namely, Manoj Rai is the agent on whose instance the medicine was loaded and was being carried to the drug agency of the petitioner namely, Sonu Anand at Begusarai.

6. Learned APP for the State opposes the prayer for anticipatory bail.

7. Taking into consideration that the petitioners have all their documents in place with regard to the license and the codein content of the consignment is 400 grams and both the petitioners have no criminal antecedent, I am inclined to extend

Let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Court Excise-II, Nawada in connection with Excise P.S. Case No.532 of 2024, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. and subject to the further condition that the petitioners shall cooperate in the investigation/trial.
