ANJANA MISHRA ORAL ORDER 11-02-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioners are in custody since 04.10.2015, in connection with Gardanibagh P.S. Case No. 366 of 2015, registered for offences punishable under Sections 417, 418, 419, 420, 467, 468, 471, 120B of Indian Penal Code Learned senior counsel appearing on behalf of the petitioners submits that though the petitioner Pappu Kumar is named in the F.I.R., the only allegation against him is that he was called by one Amit Kumar in order to allure him for getting the examination of S.S.C. passed. So far as the petitioner Shashi Kumar is concerned, he is just a technician and has no role to play.

No.3874 of 2016 (2) dt.11-02-2016 2/2 It is further submitted that one Sintu Kumar, who is said to be the brain behind the entire affair of providing answers at the examination, has been granted regular bail by this Court in Criminal Miscellaneous No. 57401 of 2015 vide order dated 21.12.2015 and one Ajit Kumar @ Ajit Kumar Singh has also been granted regular bail in Criminal Miscellaneous No. 56856 of 2015, vide order dated 16.12.2015.

Considering the aforementioned facts and circumstances, and the allegation against these two petitioners are also virtually similar to those who have been granted regular bail by this Court, let the petitioners above named be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Gardanibagh P.S. Case No. 366 of 2015.
