JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 22-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The miscreants while escaping after snatching the belongings of the prosecution party were chased and in course thereof, Rajendra Singh, co-accused was apprehended and on search, a motorcycle and a wrist watch were also recovered from his possession. Name of petitioner transpired on account of extra judicial confessional statement of aforesaid Rajendra Singh. As petitioner concealed his appearance from 2001 to 2015, on account thereof, at an earlier occasion prayer for bail was rejected. Informant has already been examined as P.W-1 who had not identified the petitioner in dock.
Accordingly petitioner, Rajesh Kumar @ Raja is
Patna High Court Cr.Misc. No.3225 of 2016 (2) dt.22-06-2016 2/2 directed to be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with one surety to the satisfaction of Smt. Smita Gaurav, Judicial Magistrate, 1st Class, Gaya, in connection with Paraiya, P.S. Case No. 39 of 2001.
Considering the conduct of the petitioner on account of having his absence since 2001 to 2015, in lieu of another bailor, is directed to deposit Rs. 10,000/- cash which will be subject to forfeit in case of default of even a single date at the end of the petitioner otherwise said amount will be returned to the petitioner after conclusion of the trial on due identification.
