JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-01-2020 This is an application for grant of anticipatory bail in connection with Town P.S. Case No. 615 of 2019, disclosing offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Recovery of 21 liters of liquor from the motorcycle. Submission of the learned counsel for the petitioner is that the motorcycle was parked in front of the house of petitioner and the same has been used by some unknown person. He has no criminal antecedent.

Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground of recovery. Having heard both sides, in view of the submissions, made above, I am not inclined to grant privilege of anticipatory

Patna High Court CR. MISC. No.3573 of 2020(2) dt.21-01-2020 2/2 bail to the petitioner. However, he has to surrender before the learned court below and make prayer for regular bail, the same shall be considered on its own merit, without being prejudiced by order of this Court, and if possible to be disposed of on the same day.
