2. The petitioner claims that he had donated land for the Government Secondary School, Nagwan in the District of Patna. On the strength of the contention made by him, he claims that he should be allowed to be a Member of the School Education Committee. The Bihar State School Education Committee Act,2000 has been brought on record by way of affidavit to this writ application, section 3 thereof deals with constitution of the Committee. The provision does not contemplate inclusion of any person as member of the Committee on the strength of he being a donor, as is evident from the language of the said
Patna High Court CWJC No.14509 of 2017(2) dt.20-02-2018 2/2 provision. The members of the Committee are to be elected in accordance with the provision under Section 3 of the Act. Claim of the petitioner has no ground at all.
3. It would be open for the petitioner to raise his claim for becoming member of the Committee on the basis of election in accordance with the provisions of the Act.
4. This application is disposed of.
