ANJANA MISHRA ORAL ORDER 28-02-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 15.09.2018 in connection with Salkhua P.S. Case No.119 of 2018 registered for the offence under Sections 364 and 365/34 (Subsequently added Section 302) of the Indian Penal Code.

Learned counsel for the petitioner submits that only because he had accompanied the deceased for a panchayat, the name of the petitioner has been brought into this case. It is further submitted that during the course of investigation one Ranju Devi wife of one Vijay Singh, from where the motorcycle of the deceased has been recovered, has stated before the police that 4 unknown persons had come and taken away the deceased and thereafter he was found dead.

Having considered the facts and circumstances and also the case diary which has no further material to implicate the present petitioner and that he is a man of clean antecedent, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa, in connection with Salkhua P.S. Case No.119 of 2018.
