During the pendency of the writ petition, he was reinstated in service. It is also stated that the departmental enquiry was conducted and the enquiry officer submitted the report. The grievance of the petitioner is that the disciplinary proceedings have not been concluded as yet.

Heard Shri Ambrish Kumar Jha, learned counsel for the petitioners and Shri Binit Kumar, learned A.P.P. for the State.

Patna High Court CWJC No.17311 of 2008 (2) dt.20-03-2015 2/2 More than seven years have elapsed since the disciplinary proceedings were initiated. There cannot be any justification to keep them pending for such a long time, particularly when the enquiry officer has also submitted his report.

The writ petition is disposed of directing that in case the disciplinary proceedings against the petitioner has not been concluded as yet, the same shall be concluded within three months from the date of the receipt of the order. In default, the proceedings shall stand terminated.
