The petitioners seek bail in anticipation of his arrest in connection with Excise Case No. 202 of 2019 dated 29.03.2019 instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

It is alleged that from a banana orchard, 4008.600 liters of liquor was recovered. The petitioner and others are said to have fled away from the scene at the time of raid. Learned counsel for the petitioner has submitted that the name of the person who identified the petitioner and others of having fled away from the place of occurrence has not been disclosed.

Apart from the aforesaid vague information that the

Patna High Court CR. MISC. No.13000 of 2021(2) dt.24-12-2021 2/2 petitioner was seen fleeing away from the place of raid, there is no other material to connect the petitioner with the offence. One Sujit Singh, whose case stands on similar footing has been granted anticipatory bail by a Bench of this Court by an order dated 02.08.2019 passed in Cr. Misc. No. 48138 of 2019. The petitioner does not have criminal antecedent. For the aforestated fact, the petitioner is directed to be released on bail, in the event of his arrest or surrender before he Court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bond in the sum of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge IX-cum-Special Judge, Excise, Motihari, in connection with Excise Case No. 202 of 2019 subject to the conditions as laid down under Section 438(2) of the Criminal Procedure Code.
