The petitioner seeks regular bail in connection with Yogapatti P.S. Case No. 367 of 2018 for the offences punishable under Sections 384/386/34 of the Indian Penal Code. The allegation is regarding the accused persons including the petitioner having forcibly filled up soil on the land of the informant with intention to commit scuffle with the informant.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is further submitted that though the petitioner is accused in three other cases, but in those three cases, he is on bail. It is further

No.7351 of 2019(2) dt.08-02-2019 2/2 submitted that the petitioner is ready to abide by such terms and conditions as may be imposed by this Court for the purposes of grant of regular bail. It is further submitted that the petitioner is languishing in custody since 10.10.2018.

On the contrary, the learned counsel for the informant has vehemently opposed the prayer for bail.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Yogapatti P.S. Case No. 367 of 2018. It is further directed that the petitioner would mark his attendance before the Officer Incharge of the concerned Police Station at 10 A.M. on each and every Monday of the week and in the event of his failure on two consecutive occasions to mark his attendance, the present privilege of regular bail shall stand cancelled automatically.
