2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 341, 323, 379, 354, 504, 448, 506 and 34 of the Indian Penal Code.
3. The prosecution case, in brief, is that on 09.04.2024 at 6 PM, these petitioners entered into the house of informant and started misbehaving and assaulting informant and her children. It is further alleged that Petitioner No. 2, namely Ravi Kumar, made photographs of daughter of informant viral and also snatched her gold locket.
4. It is submitted by learned counsel appearing on
Patna High Court CR. MISC. No.3449 of 2025(2) dt.19-02-2025 2/3 behalf of the petitioners that petitioners are innocent and have falsely been implicated in this case. Both parties are co-villagers and next door neighbors and on the alleged date of occurrence, when these petitioners were washing their vehicle the informant objected and some altercation took place between the parties and thereafter this false and concocted case has been lodged only with a view to harass and humiliate the petitioners. There are general and omnibus allegations against these petitioners. Rest of the allegations are ornamental only to make the case grievous. Petitioners claim clean antecedents.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioners.
6. Considering the aforesaid facts and circumstances, nature of accusation and clean antecedents of the petitioners, the prayer for grant of anticipatory bail to the petitioners is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Gaya in connection with Tankuppa P.S. Case No. 52 of 2024, subject to
