The petitioner is languishing in custody since 19.09.2015 in a case registered for the offences punishable under Sections 20(b)(ii)(B) of the NDPS Act.
From the wooden shop of the petitioner 1.6 kgs. of Ganja were recovered.
It is submitted by learned counsel for the petitioner that there is nothing on record to suggest that the wooden shop belong to the petitioner. The seizure list was prepared on 18.09.2015 at 6.10 P.M. which bears the case number whereas the FIR was registered on 18.09.2015 at 8.45 P.M. The petitioner was never made accused in NDPS Act.
