2. The present petition has been preferred for the following relief(s):

"I. For directing the respondents to acquire only that area of the land of the petitioner no.2 and 3 for which Gazette Notification dated 14.10.2015 has been published with respect to

Patna High Court CWJC No.15421 of 2018(4) dt.16-09-2025 2/3 acquisition of land pertaining to Khata No.223, plot no.1720 or to pay the adequate compensation for the extra land which has been exactly acquired. II. For directing the respondents to pay uniform compensation to the petitioner no.1 and 2 as has already been paid to the petitioner no.3 as the land pertaining to Khata No.223, plot no.1720 is homestead land of all the petitioners have been acquired and there was pucca home of the petitioners were standing.

III. To grant any other relief/reliefs to which the petitioner may be entitled to.

IV. To permit the petitioners to add any relief or reliefs if the occasion so arises."

Learned counsel for the petitioner submits that earlier they have moved before the Arbitrator-cum-Divisional Commissioner, Magadh Division, Gaya in Arbitration Appeal No. 141 of 2017 (Amarnath Gupta & Anr. vs. the State & Ors.) which according to the latest information, has been rejected/dismissed.

4. Learned State counsel submits that in that background, the petitioners have to move before an appropriate

Patna High Court CWJC No.15421 of 2018(4) dt.16-09-2025 3/3 authority/competent Civil Court.

5. In that background, the writ petition stands disposed of allowing the petitioner to approach the competent Civil Court.
