JUSTICE SANJAY KUMAR ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date : 26-03-2018 This application has been filed ventilating a grievance that a public road passing through Aadarsh Nagar Lane No.3, Muzaffarpur, which connects Majhauliya Aadarsh Nagar Main Road and N.H. 28, has not been properly constructed in spite of sanction granted. It is stated that sanction was granted and steps were taken for construction of 1,500 ft. long concrete road and after constructing 1,350 ft., the remaining construction has been stopped and further construction of the road is being hindered due

Neither the encroachments by the residents and influential people are being removed nor the road is being constructed and when repeated reference made to the authorities have fallen a deaf a year, this application has been filed and the relief claimed is that the remaining portion of the road, which remains unconstructed, namely 150 ft., be constructed.

Taking note of the aforesaid grievance of the petitioner, Respondent Nos. 2, 3 and 5 are directed to look into the grievance of the petitioner and ensure that encroachments are removed in accordance with law and thereafter the remaining portion of the road is constructed and made usable by the residents of the area within six months from the date of receipt/production of a copy of this order.

The application stands allowed.
