JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but in course of investigation, at para-35 of the case diary, one witness, namely, Nawal Kishore Yadav claimed that petitioner had also participated in committing the murder of the deceased. Petitioner happens to be own elder brother of the deceased and except the aforesaid witness, Nawal Kishore Yadav, none of the prosecution witnesses has stated about the participation of the petitioner in the alleged crime.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with

Patna High Court Cr.Misc. No.3276 of 2016 (3) dt.19-02-2016 2/2 two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-10, Bhagalpur in connection with Sabour P.S. Case No. 160 of 2015.
