Petitioner, who is in custody, seeks bail in a case registered for the offences punishable under Sections 366(A)/34 of the Indian Penal Code.

Informant who is the father of victim has alleged in his written complaint that his minor daughter on 02.01.2019 had gone outside in the morning to attend call of nature but she did not return back and he suspected that Gautam Singh, Uttam Singh, Sanoj Singh all sons of Dinesh Singh and Dinesh Singh forcibly took his daughter for purpose of marriage and even after much search she could not be found. The victim has been recovered and in her statement recorded under Section 164 Cr.p.c. she has denied the allegation and has stated that her

Patna High Court CR. MISC. No.1081 of 2020(2) dt.20-01-2020 2/3 mother scolded her, as such, she went to the house of her mausi and as she came to know that her father had instituted case, she returned back. She has denied any offence committed against her.

It has been submitted on behalf of the petitioner that he is innocent and has been implicated only on basis of misunderstanding and suspicion. Petitioner is in custody since 21.11.2019.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Pasraha P.S. Case No. 02 of 2019 (G.R. No. 23 of 2019), subject to conditions:

(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioner shall co-operate in the trial and shall be represented on each and every date fixed by the court.

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will
