The petitioner is languishing in custody since 30.08.2014 in a case registered for the offences punishable under Sections 457, 380 and 308 of the Indian Penal Code. The accusation is of committing theft of jewellery and other articles from the house of the neighbour of the informant when the petitioner and one Samim were apprehended on the spot, who disclosed the names of the escaped accused as Lalu and Sanjay.

It is submitted by learned counsel for the petitioner that only on suspicion the petitioner was apprehended

Patna High Court Cr.Misc. No.14540 of 2015 (02) dt.01-05-2015 2/2 and no recovery has been made from the possession of the petitioner.

A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffapur in connection with Ahiyapur P.S. Case No. 464 of 2014.
