JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-03-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 302 of the Indian Penal Code. Petitioner is named in the first information report and the informant has claimed to have seen the petitioner coming out from his house in which informant found dead body of his wife. Furthermore, informant claimed that he had seen blood like substance on the hand of the petitioner while he was coming out from the house of the informant. Police after investigation found the case true and accordingly, petitioner has been charge sheeted.

Considering the aforesaid facts and circumstances as

Patna High Court CR. MISC. No.3745 of 2019(4) dt.29-03-2019 2/2 well as submissions of the parties, I do not think it proper to extend the privilege of bail to petitioner for the present and accordingly, his prayer for bail in connection with Kalyanpur P.S. Case No. 150 of 2018 stands rejected.
