JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. No doubt, the alleged occurrence took place in the year 2008 and after investigation, police submitted charge sheet having found the case true against the petitioner but it appears from perusal of the impugned order that in course of investigation, police could only collect the circumstantial evidence against the petitioner, who is in jail custody since 07.12.2015. Moreover, submission on behalf of the petitioner is that prior to the present case, petitioner was made accused in two other cases but in both the aforesaid cases, police submitted final form in respect of the petitioner, who happens to be more than 70 years of age. Considering the aforesaid facts and circumstances as
Patna High Court Cr.Misc. No.4226 of 2016 (2) dt.09-02-2016 2/2 well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st class, Araria in connection with Araria (Tarabari) P.S.Case No. 650 of 2008.
