1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Gogri P.S. Case no.47 of 2023 registered under sections 307, 341, 323, 379, 504 and 34 of the Indian Penal Code and section 27 of the Arms Act.

3. As per the prosecution case, ten named accused persons including the petitioner herein are said to have assaulted the son of the informant. It is stated that while the petitioner and one another caught hold of the informant's son, he was beaten up by the other named accused persons. He fell down unconscious.

4. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. Even as per allegations in the FIR, the allegations of

Patna High Court CR. MISC. No.4942 of 2024(2) dt.07-02-2024 2/2 assault is not on the petitioner but on other persons named therein. The petitioner is in custody since 4.9.2023 and chargesheet has been submitted in the case.

5. Heard learned A.P.P. for the State.

6. Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the F.I.R., the petitioner not stated to be the assailant, his being in custody since 4.9.2023 and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Gogri P.S. Case no. 47 of 2023 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria.
