A supplementary counter affidavit has been filed on behalf of Magadh University in which the stand is that in absence of petitioner satisfying the authority with regard to being the sole heir of late Kishore Kumar Roy, the payment is withheld. However, learned counsel for the University submits that if the petitioner gives the required undertakings in terms of para 4 of the writ petition in which he has stated that he is the only son of his father late Kishore Kuamr Roy and further statement in para 20 that his mother died in the year 1994 itself; all due payments shall be released in his favour in accordance with law after taking the

Patna High Court CWJC No.15445 of 2008 (5) dt.15-01-2015 2/2 required undertaking/surety.

In view of the aforesaid, the application stands disposed off with a direction to the petitioner to file all relevant documents before the Registrar of the University along with a copy of this order within four weeks from today showing him to be the only son of late employee, namely, Kishore Kumar Roy . He shall also give the required affidavit/undertaking/surety in this regard. Thereafter all due payments shall be paid by the University in favour of the petitioner within the next four weeks.
