Mr.Ajay Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 16-01-2020 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Morkahi P.S. Case No. 141 of 2019 for the offence registered under Sections 147, 148, 149, 341, 323, 307, 325, 379 and 506 of the Indian Penal Code and Section 27 of the Arms Act. The allegation is regarding the accused persons including the petitioner herein having arrived at the place of occurrence and having assaulted the informant. The prosecution has alleged assault by various co-accused persons on the informant, however, as far as the petitioner is concerned, he is stated to have snatched a gold locket from the neck of the informant.

The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.1213 of 2020(2) dt.16-01-2020 2/2 that the petitioner has been falsely implicated in the present case and he is languishing in custody since 03.11.2019. It is further submitted that as far as the petitioner is concerned, there is no allegation of any sort of overt act and the petitioner has been falsely implicated on account of village politics. Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner coupled with the fact that there is no allegation of assault as far as the petitioner is concerned and he is languishing in custody since 03.11.2019, I deem it fit and proper to direct for release of the petitioner herein on regular bail.

Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Khagaria in connection with Morkahi P.S. Case No. 141 of 2019.
