JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is said to be main assailant as per ferdbeyan of the informant.

The submission on behalf of the petitioner is that in course of investigation, one Amit Pandey @ Amarjeet @ Chhotu was arrested and the said accused confessed before the police that he shot fire at the deceased.

Taking note of the aforesaid submissions as well as allegation levelled against the petitioner coupled with statements of other witnesses, I am not inclined to release the petitioner on

Patna High Court Cr.Misc. No.8773 of 2015 (4) dt.30-04-2015 bail and hence, his prayer for bail in connection with Tiyar P.S. Case No. 44 of 2014 pending in the court of Chief Judicial Magistrate, Bhojpur at Ara stands rejected.
