2. In the present case, the petitioner is apprehending arrest in connection with Ara Nawada P.S. Case No. 748 of 2023, registered on 19.10.2023 for the offences under Sections 353, 385 and 386 of the Indian Penal Code.

3. As per prosecution case, the petitioner profusely abused the informant, a government official, putting pressure on him to issue EWS certificate within one day and threatened him.

4. The learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The petitioner has submitted a written complaint to the

No.6403 of 2024(2) dt.20-02-2024 2/3 office of District Magistrate, Bhojpur regarding hot exchange of words and threats extended by the informant on the same day, i.e. on 18.10.2023 itself. When the informant came to know about the complaint submitted against him, an antedated case was lodged falsely implicating the petitioner. The present case has been lodged by the informant to save his skin from the complaint lodged by the petitioner. The petitioner is having clean antecedent.

5. Learned APP opposes the submission made on behalf of the petitioner.

6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the vague and not so serious allegation, let the petitioner above named, in the event of arrest or surrender before the court concerned within a period of eight weeks from today, be released on bail, on furnishing bail bonds of 10,000/- (Rupees ₹ Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara/concerned court in connection with Ara Nawada P.S. Case No. 748 of 2023, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure and other following conditions :

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.
