The petitioner is apprehending his arrest in connection with Akbarpur P.S.Caase no.218 of 2018 , registered for offences punishable under Sections 147, 341, 447, 354, 506 of the Indian Penal Code and Section 4 of the POSCO Act. Allegation against the petitioner and other accused persons is that they entered inside the house variously arms and started assaulting the family members of the informant and the specific allegation against this petitioner is that he thrashed the informant on the ground and tried to commit rape upon her but on hulla the people assembled thee and the accused persons including the petitioner fled away.

Submission of the learned counsel for the petitioner is that earlier to lodging of this case a case had been lodged by the

Patna High Court CR. MISC. No.2739 of 2019(6) dt.27-03-2019 2/2 petitioner's side on the father of the informant and others and further a title suit is going on between the parties and in order to pressurize the petitioner and others, the present case has been filed.

Heard learned A.P.P. and the learned counsel for the informant. They have opposed the prayer for bail stating that the girl was minor.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of6 the learned CJM, Nawada in connection with Akbarpur P.S.Case no.218 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid observation, this application is allowed.
