This is a petition for grant of regular bail for offence under Sections 302, 201 and 34 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that the petitioner is not named in the first information report. Further, it has been submitted that the name of the petitioner appeared after a period of six months where it was alleged by two witnesses that the petitioner was seen on the alleged date around the place of occurrence. It is, further, submitted that there is no eye witness to the occurrence nor there is any circumstantial evidence to suggest the implication of the petitioner. It is, further, submitted that the petitioner in jail since 19.11.2014.

On behalf of the State it has been submitted that the petitioner's name has come in

Patna High Court Cr.Misc. No.15788 of 2015 (2) dt.09-06-2015 2/2 course of the investigation and he has played and active role in the commission of the offence. Considering the aforesaid facts and circumstances, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Fatwah P.S. Case No. 167 of 2014 to the satisfaction of the Additional Chief Judicial Magistrate, Patna City.
