The petitioners apprehend their arrest in connection with NDPS Case No.97 of 2022, arising out of Industrial Area P.S. Case No.163 of 2022, registered for the offences punishable under Sections 20(b)(ii)(c)/22 of the NDPS Act. After some arguments, learned Senior Counsel for the petitioners seeks permission to withdraw this anticipatory bail application.
Patna High Court CR. MISC. No.2472 of 2023(2) dt.24-03-2023 2/2 Permission is granted.
Accordingly, this anticipatory bail application is dismissed as withdrawn.
However, if petitioners surrender before the learned court below within a period of six weeks from today and pray for regular bail, the learned court below shall consider the prayer for regular bail of the petitioners preferably on the same day without being prejudiced by this order considering the facts that petitioner no.1 is 70 years old, petitioner no.3 is a woman and the fact that no contraband article has been recovered from the conscious possession of the petitioners.
