JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-02-2020 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Fatuha P.S. Case No. 663 of 2019 registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
Petitioner no. 1 happens to be dewar of deceased whereas petitioner no. 2 is wife of petitioner no. 1. The first information report goes to show that general allegation of demand has been levelled against the petitioners and others. Moreover, the informant claims in his written report that his daughter was killed by her husband as well as her other in- laws including the petitioners but post

No.3251 of 2020(2) dt.28-02-2020 2/2 mortem report ( the photo copy) which has been annexed as Annexure-2 to this petition goes to show that no external injury was found on the dead body of the deceased and the doctor kept his opinion reserved till receipt of the F.S.L report. Considering the aforesaid facts and circumstances as well as submissions of the parties, let above named petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-V, Patna city, Patna in Fatuha P.S. Case No. 663 of 2019 subject to condition as laid down under Section 438(2) of the Cr.P.C.
