JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-02-2016 Heard learned counsel for the petitioners as well as the learned Additional Public Prosecutor of the State. One person died in an accident, but after that the driver of the truck as well as brother of owner of the aforesaid truck were caught by mob including the petitioners and others who badly assaulted them. No doubt the petitioners are named in the FIR, but no specific overt act has been attributed against them. Moreover, having more or less similar allegations coaccused Prakash Mandal and six others have already been granted privilege of anticipatory bail by a coordinate Bench of this Court vide order dated 30.11.2015 passed in Cr. Misc. No. 54172 of 2015. Investigation of this case has already been completed and

Patna High Court Cr.Misc. No.5102 of 2016 (2) dt.12-02-2016 2/2 detention of the petitioners in the present case is no more required. Accordingly, the petitioners above named are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in Kahalgaon (Ghogha) P.S. Case No. 70 of 2015.
