2. The petitioners seek bail in connection with Chiraiya P.S. Case No. 360 of 2025 registered for the offence punishable under Sections 103(1), 238 AND 61(2) of the Bharatiya Nyaya Sanhita.
3. Unknown persons are said to have killed the deceased. Subsequently, during investigation, the child witness aged about 9 years, who is the son of the deceased, has named the petitioners and others as the killers.
4. The petitioners are in custody since 20.08.2025.
5. Learned APP for the State and learned counsel for
Patna High Court CR. MISC. No.3561 of 2026(4) dt.12-05-2026 2/2 the informant have vehemently opposed the prayer for bail.
6. From the records it appears that there are materials to connect the petitioners with the crime including the statement of the child witness, I am not inclined to grant bail to the petitioners.
7. Accordingly, the application stands dismissed.
8. If the trial is not concluded within one year because of the laches of the prosecution, the petitioners may renew their prayer for bail.
9. It is, however, clarified that the observations made herein are limited to the adjudication of the present bail application and shall not prejudice the case of the petitioner at any subsequent stage of the trial and this Court has not express any opinion on the merits of the case.
