2. The petitioner seeks regular bail in a case registered for the offence under Sections 302/34 of the Indian Penal Code.

3. As per the prosecution case, petitioner is the husband of the deceased. He is said to have tortured the deceased for demand of dowry. He is also alleged to have illicit relationship with another lady.

4. Learned counsel for the petitioner submits that police after investigation has submitted the charge-sheet under Section 306 of the I.P.C. as it has found to be the case of suicide. Petitioner is in custody since 17.08.2023.

5. Learned counsel for the informant and learned

Patna High Court CR. MISC. No.7861 of 2024(3) dt.16-04-2024 2/2 A.P.P. have vehemently opposed the prayer for bail.

6. Considering the fact that charge sheet was submitted under Section 306 of the I.P.C., this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail after framing of charge if the charge has not already been framed on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bettiah, West Champaran/concerned Court below in connection with Shikarpur P.S. Case No. 656 of 2023 subject to condition that:- 7(i) The petitioner shall cooperate in the trial and shall be properly represented on each and every date fixed by the Court and on absence on two consecutive dates without sufficient reason, the bail bond shall be cancelled by the Court below.
