This application for regular bail arises out of Nirmali P.S. Case No. 08 of 2017, disclosing the offence punishable under Section 392 of the Indian Penal Code.
The petitioner's prayer for regular bail was earlier rejected by this Court by an order dated 02.12.2020 with an observation that he shall be at liberty to renew his prayer for bail after one year if, in the meanwhile, there was no progress at the trial. Accordingly, this application has been filed renewing the prayer for bail on the ground that the trial has not progressed so far.
The order dated 02.12.2020, whereby the petitioner's
Patna High Court CR. MISC. No.6033 of 2022(3) dt.09-03-2022 2/2 prayer for regular bail was earlier rejected speaks for itself. It is evident that the petitioner has criminal antecedent and the nature of accusation against him has been found to be serious. In such view of the matter, I am not inclined to grant the petitioner privilege of regular bail for the present. This application is accordingly rejected.
The petitioner shall, however, be at liberty to renew his prayer for bail after six months if, in the meanwhile, there is no substantial progress at the trial.
