JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-05-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 27.02.2014 in a case registered under section 341, 323, 302/34 of the Indian Penal Code.

Admittedly, the present case was registered in the year 1996 and after investigation police submitted final form showing the accusation untrue but learned court below differed with the findings of police and took cognizance of the offences in the year 2005.

Furthermore, it would appear from the first information report that the alleged occurrence took place at about 10.p.m and allegedly petitioner threw dagger causing injury to the informant's

Patna High Court Cr.Misc. No.13739 of 2015 (2) dt.21-05-2015 2/2 daughter, who later on died in course of her treatment. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Supaul in connection with Chhatapur P.S.Case No. 01 of 1996.
