JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 03-02-2020 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Mairwa P.S. Case No. 307 of 2019 for the offence under Sections 457 and 380 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner was not named in the F.I.R. and his name surfaced on the basis of confessional statement of co-accused Saheb Alam Ansari. The petitioner is in custody since 26.11.2019. He further submits that nothing was recovered from the possession of the petitioner.

Considering the fact that the petitioner was not named in the F.I.R. and nothing was recovered from the possession of the petitioner, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees
