JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 04-03-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners seek regular bail in a case registered for the offence punishable under Sections 147, 148, 149, 323,341, 427, 504,353,307,332,333 of the Indian Penal Code and 151,152, 174 of the Indian Railway Act.
They are students and they were agitating against the death of a fellow student who had died in a road accident. Allegedly, these petitioners and 250 other unknown persons did stone pelting on the police, abused and raised slogans. The petitioners were made accused in Sasaram (Model) P.S. Case No.
Patna High Court Cr.Misc. No.9462 of 2015 (2) dt.04-03-2015 1073 of 2014. Subsequently, they came to the Railway Station also and created disturbances.
Learned counsel for the petitioners has submitted that there is no specific allegation of any overt act against these petitioners and these petitioners have been named in the present case because they were named in the said Sasaram (Model) P.S. Case No. 1073 of 2014. The petitioners are in custody since 5.11.2014 in connection with said Sasaram (Model) P.S. case No. 1073 of 2014 and have been taken on remand on 24.12.2014, since then are in custody in connection with the present Rail Sasaram P.S. Case No. 75 of 2014.
Keeping in view the nature of allegation, let petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Railway Magistrate, Gaya in Rail Sasaram P.S. Case No. 75 of 2014.
