JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 17-03-2025 This writ petition has been filed by the petitioner seeking direction for issuance of writ in the nature of mandamus and directing and commanding the respondent authorities to make compensation with interest to the petitioner in which respondents authorities have acquired the land appertaining Khata No. 475, Plot Nos. 25505 area 33/4 decimal without any process of land acquisition or notice to the petitioner and further prayer for direction to respondents authorities to comply the order passed by learned Addl. Collector (Public claim Redressal) Distt. Sitamarhi -cum- 1st Appellate Tribunal in case No. 999957926041700433/1A and also order passed by learned

Patna High Court CWJC No.15017 of 2018(3) dt.17-03-2025 2/3 Distt. Collector, Sitamarhi -cum- II Appellate/ Tribunal in case No. 999957926041700433/2A vide orders dated 16.08.2017 and 11.12.2018 respectively whereby and where under respondents have been directed to remove the illegal encroachment in question of raiyati land of petitioner, if any, and any other relief/reliefs for which the petitioner is found to be entitled in the eye of law.

Learned counsel for the petitioner submits that the Anchal Amine submitted the report dated 18.02.2014 (Annexure-4) in which it is stated that the road has been constructed on the petitioner's land bearing Khesra No. 25505 area 3.8 decimals. He further submits that this case may be disposed of with liberty to the petitioner to make the representation before the appropriate authority for redressal of his grievance.

3. Learned counsel for the State has no objection to this prayer of the petitioner.

4. In view of the submissions of the learned counsel for the parties, the present writ petition stands disposed of with liberty to the petitioner to make the representation before the appropriate authority for redressal of his grievance within a period of four weeks.
