2. The petitioner seeks bail in connection with N.D.P.S. Case No. 65 of 2023 CIS No. 65 of 2023 (Arising out of Govindganj (Areraj) P.S. Case No. 100 of 2023 registered for the offence punishable under Sections 399, 402 and 414 of the Indian Penal Code; Sections 25(1-b)a, 26 and 35 of the Arms Act and Sections 20(B)(ii)(c), 22 and 23 of the N.D.P.S. Act.

3. One Suraj Tiwari was apprehended by the police from whose possession a pistol and 1 Kg. 28 grams of charas have been recovered. The petitioner has not been caught on the spot. He is in jail since 02.09.2023.

4. Learned APP appearing for the State opposes the

Patna High Court CR. MISC. No.9283 of 2024(3) dt.16-04-2024 2/2 prayer for regular bail of the petitioner.

5. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail after framing of charge if charge has not already been framed, on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 14th Additional Sessions Judge, East Champaran, Motihari in connection with N.D.P.S. Case No. 65 of 2023 CIS No. 65 of 2023 (Arising out of Govindganj (Areraj) P.S. Case No. 100 of 2023.

6. The petitioner will also mark attendance in Pipra Police Station, East Champaran on the first and third Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) P. Kumar U T
