JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but from perusal of the impugned order, I find that the petitioner was remanded in this case from another case and at the time of passing impugned order dated 05-01-2016,, except confessional statement of the petitioner, there was nothing against him and, furthermore, I find that investigation against the petitioner was pending at the time of passing impugned order. Moreover, it appears that except the confessional statement and criminal antecedent of the petitioner, there appears to be nothing against him.
Considering the above-said facts and circumstances of the
Patna High Court Cr.Misc. No.5015 of 2016 (3) dt.15-02-2016 case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Siwan Muffasil P.S. Case No. 375 of 2015 to the satisfaction of learned Sub Divisional Judicial Magistrate, Siwan subject to condition that if, at the time of accepting bail bonds of the petitioner, the court below finds any more material against the petitioner in the case diary of the present case, the petitioner shall not be released on bail by the concerned court.
