The petitioner apprehends his arrest in connection with Bakhtiyarpur P.S. Case No. 08 of 2017 registered under Section 353 of the Indian Penal Code and Section 135 of the Indian Electricity Act.

The accusation is of consuming of electric energy in the Tower of M/S Tower Vision Indian Pvt. Ltd. and causing loss of Rs.4,34,312/- to the Electricity Department, where the petitioner was posted as guard.

Learned counsel for the petitioner submits that petitioner being the guard of M/S Tower Vision Indian Pvt. Ltd.

Patna High Court CR. MISC. No.10390 of 2019(3) dt.15-05-2019 2/2 has falsely been implicated in this case and he has no concerned about the profit or loss of M/S Tower Vision Indian Pvt. Ltd. rather he is only withdrawing the salary from the M/S Tower Vision Indian Pvt. Ltd.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa, in connection with Bakhtiyarpur P.S. Case No. 08 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
