The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and 47(a) of the Excise Act. Country made and foreign liquors were recovered from the shop of Ramakant Thakur when one Sunil Das was apprehended. Subsequently it was found that the house was situated in the house of the petitioner. Thereafter some recovery of the liquor was made from Damodar Prasad which it is alleged to be the godown of the same shop keeper. It is submitted by learned counsel for the

Patna High Court Cr.Misc. No.3489 of 2016 (2) dt.21-01-2016 2/2 petitioner that as per the seizure list the recovery has been made from the shop of Ramakant Thakur and the petitioner has been roped in since he happens to be the owner of the house in question.

A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Raxaul at Motihari in connection with Ramgarhwa P.S. Case No. 135 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
