JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 16-03-2016 Heard learned counsel for the petitioner and learned A.P.P. representing the State.

The petitioner seeks bail in connection with Mohania P.S. Case No. 422 of 2015 registered for the offences punishable under Sections 379, 420 and 411 of the Indian Penal Code. Allegedly, the petitioner hired taxi and came to Mohania, where the petitioner told the driver (informant) to make query of a person and when he went at the gate, the petitioner speeded away with the vehicle but due to timely intervention of the local police, the petitioner was apprehended with stolen vehicle at Koilwar.

Submission is of false implication due to dispute relating to fare, the petitioner has got no criminal antecedent and is

Patna High Court Cr.Misc. No.3521 of 2016 (3) dt.16-03-2016 2/2 suffering in custody since 1.11.2015 to which the learned A.P.P. opposes by submitting that the petitioner has confessed his guilt stating his criminal antecedent as he is involved in the racket of selling stolen vehicles.

In the facts and circumstances stated above, the petitioner, above named shall be released on bail after completion of six months custody from the date of his remand on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Kaimur at Bhabua in connection with Mohania P.S. Case No. 422 of 2015 subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
