JUSTICE RAVI RANJAN ORAL JUDGMENT Date: 08-02-2017 Heard learned counsel for the petitioner and the State. Petitioner claims that he joined as Veterinary Surgeon at Buxar on 04.07.2015 on his transfer from District Kaimur to Buxar.

However, by the impugned Annexure-P/9 dated 20.12.2016, he has again been transferred to Bhojpur as District Animal Husbandary Officer.

This Court does not find it a case for interference on that count. However, the petitioner further claims that he is to retire on 28.02.2017 itself and in view of the notification of the Government

Patna High Court CWJC No.596 of 2017 dt.08-02-2017 he should be considered for his posting of choice. Accordingly, let a decision be taken by the respondent no. 2, the Principal Secretary, Animal and Fisheries Department, Government of Bihar, Patna on his representation, as contained in Annexure-10 expeditiously preferably within a period of two weeks. It is made clear that in view of such notification petitioner's case should be sympathetically considered for retaining him at Buxar itself in view of his date of superannuation on 28.02.2017.

Till any decision is taken, let the petitioner continue at Buxar itself.

This disposes of the writ petition.
