JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The victim has not been recovered as yet but admittedly, prior to institution of the present case, Navinagar P.S. Case No. 86 of 2015 had been lodged in respect of kidnapping of victim of the present case and in the aforesaid case, victim was recovered and specifically stated in her statement recorded under Section 164 of the Cr.P.C. that she was in love with co-accused, Wasim Akram and had solemnized her marriage with the aforesaid co-accused.

The contention on behalf of the petitioner is that as a matter of fact, the victim herself eloped with co-accused, Wasim Akram but the informant lodged the present case against the

Patna High Court Cr.Misc. No.3584 of 2016 (2) dt.04-02-2016 2/2 petitioner also.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Aurangabad in connection with Navinagar P.S. Case No. 147 of 2015.
