JUSTICE JYOTI SARAN ORAL JUDGMENT Date : 17-07-2019 It is because the order passed in a contempt application yet was not complied that the petitioner returned and this Court bearing note of the situation as well as the stand of the District Magistrate, Aurangabad, by its order dated 19.06.2019 put the Engineer -in-Chief, South Bihar, Rural Works Department on notice because even though the recommendation made by the Committee under the Chairmanship of the District Magistrate,

Patna High Court MJC No.2827 of 2018 dt.17-07-2019 2/2 Aurangabad in favour of the writ petitioner and some others was on the requisition placed by the Rural Works Department but on receipt of the recommendation that impediment was being created by him.

This Court by a discussed order passed on 19.06.2019 while directing the Engineer-in-Chief, Opposite Party no. 11 to be present in Court on 10.07.2019 for framing of charge for bringing obstacles in implementation, allowed him to take corrective measures before the next date. The result is that by order dated 03.07.2019 placed on record at Annexure 'F' that the petitioner along with six others have been appointed on the post of Peon in the light of the recommendation made by the Committee chaired by the District Magistrate, Aurangabad. The position is explained by a show cause filed on behalf of the Engineer-in-Chief on 11.07.2019.

In such view of the matter, where the order of this Court stands complied, I dispose of the contempt application. The notice issued to Mr. Praveen Kumar Thakur, the Engineer-in-Chief, who is present in Court answering the notice, stands discharged. The contempt application is disposed of accordingly.
